this is a gamasutra news article about a lawsuit whose results will be important for any games that allow user configuration or content creation.

copyright law usually allows use of trademarks for academic or non-commercial use, and it's pretty clear to me that in this case the users aren't getting anything out of it, BUT with the commercialisation of game content seen in a lot of MMORPGs, it could become a skeleton of serious contention.

I just read about this on slashdot. Can't say I'm surprised. I played CoH for a while - and as a player, I found it rather annoying to see Cyclops and Wolverine clones - but even worse, f***ing Captain America!

I don't think Marvel can win, and if they do, does that mean that all the medieval games with players who are wizards named Gandalf will get sued too?

I also think that it's rather stupid, because by telling NCsoft to remove the possibility for the super heros to look like registered trademarks they alienate people who are in their fanbase (ie: The people playing CoH).

How much would you want to buy a comic after having devoted hours of your life to a game where you almost (but don't) get to play as Wolverine, only to be told that your character cant exist anymore?

I think this lawsuit was a bad move.
