All of those (except for selling, which you clearly are allowed to do, as evidenced by the existence of used book stores) are actually talking about creating a new copy or derivative work, not about modifying the one you bought. So, what Gwardinen said. At any rate "intellectual property" is a different beast from personal property, which is what a PS3 is. Insurance companies can cancel your insurance for whatever reason they want. Your premiums go up if you paint your car red; that doesn't make it illegal. I don't think anyone is suggesting that Sony should "support" homebrew either. They reserve the right to kick you off PSN or whatever because that's an ongoing service that they're providing, but they don't have a right to dictate what you can and can't do with the machine after you've bought it. They can try, but if you're able to get around it they don't have a legal basis to do anything about it. It really isn't. Buying a PS3 is not a contract. You're not leasing it from them. You give them money and then you own it and they don't. which homebrew isn't. Sure it can be used for piracy, but it's the piracy that's illegal, not the modifications that make it possible.

Sony's business model is none of the consumer's concern. When someone buys a piece of hardware, they have every right to use it however they see fit, and if your business model doesn't allow for that, that's your problem, not the consumer's. No, you don't. If they want to sell a console, they have to acknowledge that people will then own that console, and at that point they no longer have control over what happens to it. That's what ownership means. It's like if you bought a car and the manufacturer tried to forbid you from installing your own preferred brand of spark plugs or whatever. They can't. The correct response to this is for them to make their spark plugs good enough that people want to continue to use them. The incorrect response is to threaten their customers.

Your eyes really need to be parallel to the screen, so looking over someone's shoulder is never going to work very well. I've been playing it pretty extensively and it hasn't felt any harder on my eyes than a normal DS screen. But yes, the slider is very important; for me, about a third of the way up is best, and it's hard to even get the images to converge if I put it all the way up. I guess it depends on how far apart your eyeballs are.

I'm enjoying Pilotwings a lot. People are complaining that there's not enough to do, but there's a good amount of variety in the missions, and they get difficult enough that I doubt I'll ace them all any time soon. I actually like the free-flight mode more than the missions. It's nice to just chill out and fly around a bit, maybe pick up a few collectibles if I feel like it. I find it relaxing. It reminds me of what I liked about Endless Ocean (which, come to think of it, would be great on the 3DS).

I've been playing it. It's really good. The port has a few minor issues (mostly in the sound department), but it's really nice to be able to play it from my couch and in widescreen. You can switch back to the old graphics if you want, but the new ones are quite nice and still completely in the same style, just higher resolution. But I do recommend switching to the old music immediately and lowering the sound effects volume quite a bit.

Clearly I'm in the minority here, but... I actually like the ridiculous choir samples. I would have found the NSMB music pretty bland and forgettable, but those cheesy samples partially redeem it for me. Also, I believe the reason you can't use the classic controller is that there are some platforms and things that you have to tilt the wiimote to manipulate.

I'm super pumped too. I was a little disappointed with NSMB DS, but everything I've seen about this one looks very promising (Koopalings!). I am hoping that they tightened up the controls a bit, though; the DS one always felt a little too slow and slippery to me. I'm looking forward to playing the multiplayer with my wife... we had a ton of fun with Zelda: Four Swords Adventures, and this looks to have a similar sort of blend of cooperation and competition. Plus, there's a penguin suit. Amazon's predicting my copy will arrive on Wednesday; now I kind of wish I'd just bitten the bullet and pre-ordered from the nearest Gamestop. Going to watch that Giant Bomb thing now.

I always loved the part in the Bowser fight in Super Mario World when his little clown-car flies directly at the camera, blowing you away with the graphical effects. My friends and I always tried to pause the game on the last frame of that animation so we'd have nothing but a white screen with a giant blocky eye. Good times!

I got the Punch-Out!! demo too, but I already have the full game, so it isn't doing too much for me. I'm not sure what I was expecting. I don't know what I would have done with a Mario hat, though. The Japanese Club Nintendo prizes are so much cooler. I did just order the three Zelda posters with some of my coins, but they haven't arrived yet. I'm also pretty tempted by the hanafuda cards, but I don't have enough coins left... maybe after the holidays.

It strikes me as slightly clumsy for ordinary IM-style chats, but quite handy for collaborating on a thing or holding discussions among more than two people. I also like how the waves sort of exist independently of the participants, so at any time, people can drop in or out. If there's something going on at that moment you can participate in real time, or you can just leave your contributions and come back to it later and use the playback thing to catch up on what you missed. I think it has a lot of potential (especially as a protocol and not just a thing on a single web site), but it will probably take a while to figure out how to make the most of it. I just hope that enough people will stick with it long enough for that to happen.

I dunno, my friends and I have been having a lot of fun with it. It's not hard for me to imagine it taking the place of email and chat for most of my online interactions with them once it gets a bit more polished. But then, I am a sucker for gimmicky internet things. I'm sorry to have missed out on the Thumbs-related wackiness.

I was so sad when I got up this morning and saw that this was still happening and it hadn't all just been a horrible nightmare. I keep hoping to see a post saying it was actually a cruel joke, or that due to the overwhelming response Chris and Jake have decided to keep casting their pods into our faces after all. With every hour that passes, that seems less likely.

But isn't this a pretty good way to become visible in the first place? Lots of people who wouldn't have bought the game will buy it if they can get it really cheap. They may not be paying much, but if the alternative is them not buying it at all, you're still coming out ahead. I'd be a lot more willing to spend a couple of bucks to take a chance on an unknown than I would be to spend $20 (or whatever), and then if I like it, I'll be willing to pay more for their next one. Maybe I'm being really naive, but I think most people who are really interested in your product and would have bought it at a normal retail price will still be willing to pay non-negligible amounts for it. Those people may still be paying less than MSRP, but on the other hand, thousands more people are being exposed to it. I don't know how well the money balances out, but even if it doesn't, I'd think the exposure might be worth it (especially if you're not already well-established) since you end up with a much larger pool of people who like your stuff and could potentially support your next project.
